The 4 C's of Consent are: clear, continuous, coercion- free, and conscious. Without ALL of these components, you do not have consent.

This is Part 1 of a beginning lesson on Contracts for the legal studies, business law, prelaw or paralegal student. It discusses the first 2 Cs of any Contract: Consent and Capacity. This lesson should be done with Part 2, which discusses the other C's: Consideration and Complies with the Law and/or Public Policy.

The basic elements required for the agreement to be a legally enforceable contract are: mutual assent, expressed by a valid offer and acceptance; adequate consideration; capacity; and legality.

It is a legal framework for the agreement between the parties, which is both certain and enforceable. However, to be legally binding, a contract must include four key elements: an offer, acceptance, consideration, and an intention to create legal relations.

The 21st century learning skills are often called the 4 C's: critical thinking, creative thinking, communicating, and collaborating. These skills help students learn, and so they are vital to success in school and beyond. Critical thinking is focused, careful analysis of something to better understand it.

In doing so, as is industry practice, the surety will focus on the three “C's”: capital, capacity, and character. A surety must ensure that a principal has the financial wherewithal to be able to complete a project and fulfill its obligations under a contract.

In the context of contract law, the term “capacity” denotes a person's ability to satisfy the elements required for someone to enter binding contracts. For example, capacity rules often require a person to have reached a minimum age and to be of sound mind.

The most basic rule of contract law is that a legal contract exists when one party makes an offer and the other party accepts it.

Capacity refers to the fact that both parties have the legal capability to enter into a contract, such as being of legal age. Mutual assent, consideration, legal ability, and legality are the four fundamental elements that must be met in order for a contract to be valid.

One way in which we can ensure our own behaviour is respectful of others is by following the five pillars of consent. Consent must be: revocable, conscious, enthusiastic, verbal and ongoing. In so doing we ensure all parties are agreeable and we aren't overstepping personal boundaries.
